Elon Musk's lawyers are fighting a request from a group of Dogecoin investors to remove them from the case. The plaintiffs accused the lawyers of engaging in inappropriate behavior. Musk's lawyers called the request an "insult" and a waste of the court's time.
In a 17-page filing, Musk's lawyers denied the plaintiffs' allegations. They said the allegations, including claims that Musk lawyer Alex Spiro leaked a derogatory letter to the press, were baseless and failed the legal "laugh test." This legal doctrine takes into account the severity of a claim.
Musk's lawyers emphasized that there was "absolutely nothing funny" about the plaintiffs' allegations and that instead it was plaintiffs' attorney Evan Spencer who behaved inappropriately. They claimed that Spencer's request was so inappropriate that he should be sanctioned himself.
Spencer's motion was filed on June 26 and accused Musk's lawyers of demonstrating a pattern of derogatory and oppressive behavior. In particular, Spiro was accused of using dirty tactics by allegedly leaking a letter to the press disparaging his competence.
Spencer also asked the judge to fire Allison Huebert, a lawyer for Tesla, because of an alleged conflict of interest. He demanded that Musk's lawyers be financially punished for their behavior.
Musk's team denied the allegations and stated that Spencer's allegations were unfounded. Even if they were true, this would not violate ethical rules that prohibit communication with the press.
The lawyers also argued that New York law allows for simultaneous representation of executives and their companies. They called Spencer's argument an "imaginative invention."
The court battle between Elon Musk and Dogecoin investors began in June last year. The plaintiffs accuse Musk of being part of an extortion scheme in favor of the cryptocurrency. Musk denies any wrongdoing and emphasizes his interest in DOGE.
It remains to be seen how the judge will respond to the plaintiffs' request and how the court dispute will continue.
